We engaged this builder for a full house renovation, with a contract stipulating completion within 60 days. As of 26/05/2025, the project still remains incomplete. Despite this, the builder initiated legal action over unpaid invoices. We withheld payment because, in our view, the work was not completed to an acceptable standard. Throughout the process, we encountered several issues, including what appeared to be double charges for certain items like downlights — which we only caught through close attention to the invoices. The builder was rarely present on-site, and we only saw them a handful of times over the entire project. Another concern was that tradespeople began contacting us directly, claiming they had not been paid, even though we had settled our invoices with the builder. We provided evidence of our payments to those tradespeople, but it placed us in a very uncomfortable position. Based on our experience, we would not engage this builder again. The work was completed on 3rd May 2025, expect for omissions or minor repairs. We put a claim into NCAT for payment from you due to your mum’s refusal to pay the 5 outstanding invoices that were sent to you end April and 5th May. NCAT Member asked was the kitchen, laundry and stone benchtop fitted, your mum Vilma answered yes, why didn’t you pay the invoice, your mum didn’t respond to the Member. Member asked were the variations signed, yes, work completed, yes, why didn’t you pay the invoices, your mum again didn’t respond the Member. No evidence or documents were provided about the 2 downlights that you claim we overcharged at NCAT. I provided a list of LED downlights fitted as per your mum’s email request; she did not respond or answer that email to substantiate the claim put forward. Member looked at the spreadsheet provided to him with the minor repairs or omissions that needed to be completed, the list of items was provided to us by your mum Vilma. Minor repairs and omissions that were to be completed, some grouting, and silicone, Fitting 2 flyscreen doors and repair of 1 flyscreen door. You were still holding the final payment on top of the 5 outstanding invoices. There were delays due to variation changes. Increase in length of laundry as Vilma wanted washer & dryer side by side instead of on top of each other as per the original plans and contract, additional timber work and tiling work and increased size in stone benchtop all took additional material and labour hours to complete. Tilers delay the entire floor tiling job by 2 weeks, then the painters were delayed. Your mum requested that we change the layout of bedroom 3 after we had completed the work as per the contract, additional work and time involved in this caused delays to the job. That is a false statement about my time on site. Nicole, you moved out of the home and were hardly there, if so a few times for 10 minutes. All trades have been paid, that statement is false. Your mum, Vilma stated to the electrician he wasn’t getting paid and caused a lot of issues due to this, our subcontractor confirmed this to me in a phone call, which we had to sort out. Friday 2nd May your dad was aggressive and abused me on site, in front of 5 trades. I was doing a final walk through with your mum Vilma discussing the minor repairs needed to be completed, another subcontractor was with me at the walk through who confirmed the minor work to be completed and you, Vilma agreed to all. In an email received from your mum 6 May 2025, ‘Your tradies were disappointed with what happened last Friday? Good! Again, no invoices will be paid. We settled at NCAT as I did not want to return to an aggressive and hostile environment, where I could not guarantee the safety of myself or my trades.Fran E

Hi Fran, The reason you are receiving invoices is for the additional electrical work etc. and that you ran out of funds twice and we had to wait for you to refinance. Invoices are owed and refusing to pay them. Currently this matter is before NCAT due to non-payment of invoices, for which you agreed that you requested the work to be done and the job has been finished. The reason for the added length to the job is the following: Below is a list of items that were changed and changed again, this all takes time to complete, hence the increase in completion time. After demolition of walls etc. it was found that your house had 3 different floor levels, which took some time to work out and rectify. Changed position constantly during the renovations of different aspects of the build. 1. Changed position of large window in studio to dining room, had to rebuild timber stud walls in the dining room to meet up with the deck, this was last minute. 2. Dining room wall facing neighbour we had prepared for a window, last minute decision they didn’t want a window there at all. Had to rectify this wall, labour hours and material. 3. Studio room had to rebuild wall where large window was to accommodate for a highbay window. 4. Kitchen position changed from original plans on two (2) separate occasions. 5. Final layout of kitchen kept changing different ideas of where the cupboard should end, increased size in Island bench, airfryer, microwave unit drawing on hallway wall to be included in the plan, this was NOT the contract which added to the build time of the kitchen. 6. Bathroom size increased halfway through the build, took longer to complete due to increase in size for waterproofing, tiling etc. increased size of your PC Items. 7. Laundry size changed as you wanted a separate toilet to be included halfway through the build, and requested plumber to add small basin in separate, which was not in the contract. 8. Your partners work nook area, additional timber, electrical and data for this area which was decided on at the last moment. 9. Additional electrical work throughout the build, every time electrician attended there were additional requests to complete more work. Contract allowed 14 LED downlights, you had 34 additional LED downlights, additional powerpoints, spotlights at rear, kitchen pendant lights (not part of the contract). 10. Weather delays experienced. 11. Shortage of materials experienced throughout the renovation 12. Shortage of subcontractor’s availability to attend to complete work required as they were booked out due to the shortage in the building industry. 13. Changed built in wardrobe to a walk-in- robe at the last moment, which took additional time and material to build. From Contract “Supply and fit built-in wardrobe to bedrooms 1, with white melamine parcel shelf and chrome hanging rails only” 14. Additional Variation work for house remove asbestos external cladding, wait time for subcontractor to be able to complete. Waited on Clearance before we could commence work then supply and fit additional cladding, verandah work, tiling on verandah, 15. Change in the back steps size to be mobility friendly, additional time to work out treads and material to build. 16. Change in style of handrails for deck. 17. Due to the numerous variations and type of work requested added to the renovation, build time. 18. Rear deck gate, advised this at the last moment. 19. Requested that the right-hand side of the house at the rear to be made “doggy proof” with timber apron, additional labour hours and material. 20. Lattice to be fitted to left hand side of bottom of house to make animal proof.Joanne D
